Terms of Use

This document/agreement (hereinafter referred to as "Agreement") sets forth the Terms (hereinafter referred to as "Terms") that apply to the access and use of the website (www.Eazyway.io), (collectively referred as "Platform" or "Eazyway.io website') ) which is managed and operated by Eazyway Corporate Consulting Private Limited a company incorporated and registered under the Companies Act, 2013 bearing Corporate Identification Number (CIN)- U74999KA2018PTC117867 having its registered office at No 121, 2nd Floor, 4th Main, 1st Stage, West Of Chord Road, Manjunathnagar, Bengaluru 560010, India (hereinafter referred to as "Company"). By using the Platform, you are confirming your acceptance to be bound by the provisions of these Terms of Use, including the Platform Privacy Policy Statement.

These Terms are a legally binding document and constitute an electronic record as prescribed under the Information Technology Act, 2000, and the rules made thereunder, and are generated by a computer system and do not require any physical or digital signatures. This Agreement is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries Guidelines) 2011, which provides for the due diligence to be exercised in accessing or using this Platform.

These Terms govern the access to and use of the Company's Platform and the Services provided thereunder. Please read these Terms carefully, and if you do not agree to accept these terms, please do not use this Platform and its services. The user (unless specified or apparent from the context, shall refer to any individual or the entity using the Platform to avail Services as mentioned under clause 1.8) by accepting the Terms or by accessing, downloading, installing, browsing or otherwise using the Platform agree that the user have read, understood, acknowledged and accepted these Terms and use of the Company's Platform, products and Services. This Agreement, along with the Privacy Policy, describes the relationship between the Company and users and is subject to the rules, guidelines, policies, terms, and conditions applicable to any Service provided by the Company through this Platform, and shall be considered part and parcel of these Terms.

PLEASE READ THESE TERMS CAREFULLY. YOUR USE OF THE PLATFORM SHALL CONSTITUTE DEEMED ACCEPTANCE OF THESE TERMS AND CONSTITUTES A BINDING AGREEMENT BETWEEN YOU AND THE COMPANY FOR THE PURPOSE AS STATED HEREUNDER.

"Candidate "means any individual with a jobseeker account on the Service.

"Client "means any individual or company with a recruiter administrator account, recruiter account or collaborator account on the Service.

"User" means any entity with an account on Eazyway.io.

"Service "means all services provided by Eazyway, including recruitment and applicant tracking software, assessments, job description generation, video interviewing software, automated reference collection and checking, video resume generator, discussion forums, consultation sessions, third-party workshops and any other service that Eazyway introduces from time to time.

"Recipient "means Job seeker and/or any person availing the Service of third-party coaches, including scheduling consultation sessions, or participating in question and answer/discussion forums or third-party workshops.

When you create an account with us, you must provide accurate, complete, and up-to-date information at all times. Failure to do so (including providing any false information, or failure to provide any material information) constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any security breach or unauthorised use of your account.

We bring to the notice of all concerned that we do charge or accept amounts from job seekers during the selection process, as per the Subscription Plan. If any other person receives any unsolicited or fraudulent communication offering a job or an interview call in the name of Eazyway.io against payment of money, it is suggested not to respond.

We shall not accept any liability for any representation made in any fraudulent communication or for its consequences, and such fraudulent communication shall not be treated as any kind of offer or representation by Eazyway.io.

Some parts of the service may be available on a "Pay per Use" basis. For such services, you will be able to view the price and will need to make an upfront payment to use the service. Services bought on a Pay-Per-Use basis are non-refundable.

We reserve the right to moderate questions posted by users in accordance with our internal policies, and any decision in this regard, including non-display of questions, is solely at our discretion.

Personal information you provide to Eazyway.io through the Service is governed by Eazyway.io's Privacy Policy. Your election to use the Service indicates your acceptance of the terms of the Eazyway.io Privacy Policy. You are responsible for maintaining the confidentiality of your username, password and other sensitive information. You are responsible for all activities that occur in your user account, and you agree to inform Eazyway.io immediately of any unauthorised use of your user account by email to connect@Eazyway.io. Eazyway.io is not responsible for any loss or damage to you or to any third party incurred as a result of any unauthorised access and/or use of your user account, or otherwise.

The Service may include certain communications from Eazyway.io, such as service announcements, administrative messages and newsletters. You understand that these communications shall be considered part of your use of the Services. As part of our policy to provide you with total privacy, we also provide you with the option of opting out of receiving newsletters from us. However, you will not be able to opt out of receiving service announcements and administrative messages.

You understand and agree that, as a part of the Service, Eazyway.io may disclose to employers on its platform certain aggregate information contained in your profile so that they can reach out to you via the platform regarding employment opportunities. Eazyway.io will not disclose to any third party your full name, address, e-mail address or telephone number without your prior consent, except to the extent necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant.

We employ technical access controls and internal policies to prohibit employees from arbitrarily accessing user data. We adhere to the principles of least privilege and role-based permissions to minimise the risk of data exposure.

We endeavour to ensure the security of your data by backing up your data on a regular and timely basis. Daily backed-up data is retained for a week, weekly backed-up data is retained for four weeks and monthly backed-up data is retained for twelve months. Data is deployed in a unique virtual private cloud (VPC) with dedicated firewalls. Additionally, all network traffic is encrypted using Transport Layer Security (TLS).

As data controllers, in the event of any breach, we will notify the relevant Data Protection Authority within 72 hours of becoming aware of it, in accordance with the General Data Protection Regulation (GDPR). As data processors, we shall inform the concerned data controllers of any breach without undue delay. We shall also notify users of a breach, where applicable, in accordance with specific requirements.

Application data is stored on resilient storage that is replicated across data centres. Data in the primary Data Centre is replicated in the secondary Data Centre in near real time. In the event of a failure of the primary Data Centre, the secondary Data Centre takes over, and operations continue smoothly with minimal or no loss of time.

Here are the things that users can do to ensure security:

• Choose a unique, strong password with at least 8 characters and protect it.
• Use the latest browser versions to ensure they are patched against vulnerabilities.
• Exercise reasonable precautions while sharing data from our cloud environment.
• Manage roles and privileges for your account.
• Be aware of phishing and malware threats by looking out for unfamiliar emails, websites, and links that may exploit your sensitive information by impersonating Eazyway.io or other services you trust.

We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other websites.

As a result, it is your responsibility to verify any information before relying on it. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content "). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness. Eazyway.io shall not be liable for any third-party Content.

By posting or making available Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service, and you are responsible for protecting those rights. You agree that this license includes the right for us to make your Content available to other users of the Service, who may also use your Content subject to these Terms.

You represent and warrant that:

a. The Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and

b. The posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

You agree to protect, defend, indemnify and hold Eazyway.io and its affiliates, officers, directors, employees, agents, associates or other partners, harmless from any claim or demand, including reasonable attorneys' fees made by any third party due to the Content you submit, post or transmit through the service, your use of the service, your connection to the service, your violation of the terms and conditions or your violation of any rights of another user.

You agree to be solely responsible for the contents of your transmissions through the Service. You agree not to use the Service for illegal purposes or for the transmission of material that is unlawful, defamatory, harassing, libellous, invasive of another's privacy, abusive, threatening, harmful, vulgar, pornographic, obscene, or is otherwise objectionable, offends religious sentiments, promotes racism, contains viruses or malicious code, or that which infringes or may infringe intellectual property or other rights of another. You agree not to use the Service for the transmission of "junk mail", "spam", "chain letters", "phishing" or unsolicited mass distribution of email. We reserve the right to terminate your access to the Service if there are reasonable grounds to believe that you have used the Service for any illegal or unauthorised activity.

We respect your right to ownership of content created or stored by you. You own the content created or stored by you and grant Eazyway.io permission to access, copy, distribute, store, transmit, reformat and publicly display the content of your user account as required for the purpose of providing the Service to you.

The Service, its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Eazyway.io and its licensors. The Service is protected by copyright, trademark, and other laws of both Singapore and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Eazyway.io. Any unauthorised use of our intellectual property is prohibited.

Our Service may contain links to third-party websites or services that are not owned or controlled by Eazyway.io. Eazyway.io has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Accordingly, Eazyway.io makes no representations whatsoever concerning the content of those sites. You further acknowledge and agree that Eazyway.io shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit. There are risks in using any information, software, or products found on the Internet, and Eazyway.io cautions you to ensure that you fully understand these risks before retrieving, using, relying upon, or purchasing anything via the Internet.

In addition to all other terms and conditions of this Agreement, you shall not: (i) transfer the Service or otherwise make it available to any third party; (ii) provide any service based on the Service without prior written permission; (iii) use the third party links to sites without agreeing to their website terms & conditions; (iv) post links to third party sites or use their logo, company name, etc. without their prior written permission; (v) publish any personal or confidential information belonging to any person or entity without obtaining consent from such person or entity; (vi) use the Service in any manner that could damage, disable, overburden, impair or harm any server, network, computer system, resource of Eazyway.io; (vii) violate any applicable law; and (viii) create a false identity to mislead any person as to the identity or origin of any communication.

Eazyway.io reserves the right to terminate unpaid user accounts that are inactive for a continuous period of 120 days. In the event of such termination, all data associated with such a user account will be deleted. Eazyway.io will provide you with prior notice of such termination and the option to back up your data.

These Terms and Conditions are deemed to be accepted by you upon your signing up for our Service. Our failure to enforce any right or provision of these Terms will not constitute a waiver of such rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we may have had.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may delete your account by visiting your "Account Settings" page or contacting us at compliance@Eazyway.io

Your use of the Service and reliance on the Content of the website is at your sole risk. The Service and Content is provided on an "AS IS" and "AS AVAILABLE" basis without any warranty of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. Eazyway.io makes no representations about the suitability of the Content of this site for any purpose. Eazyway.io will not be liable to anyone with respect to any damages, loss or claim whatsoever, no matter how occasioned, in connection with access to or use of the Contents of this site. In no event shall Eazyway.io be liable for any special, indirect, exemplary or consequential damages or any damages whatsoever, including but not limited to loss of use, data or profits, without regard to the form of any action, including but not limited to contract, negligence or other tortious actions, arising out of or in connection with the use, copying or display of the Content. Eazyway.io, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

You agree to defend, indemnify and hold harmless Eazyway.io, its affiliates, officers, directors, employees, agents, associates or other partners from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these terms and conditions; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; (iv) any claim that your Content caused damage to a third party; or (v) violation of any applicable laws. This defence and indemnification obligation will survive these terms and conditions and your use of the Service.

We may amend our Terms at any time by publishing revised Terms on our Website and/or by sending an email to the address you gave us. These Terms are current as of the Effective Date set forth above. If any changes are made to these Terms, we'll post them on this page, so please be sure to check back periodically. If you continue to use Eazyway.io after those changes are in effect, you agree to the revised Terms. Therefore, it is important that you periodically review our Terms to ensure you still agree to them. If you object to any such modifications, your sole recourse will be to cease using this Website. Eazyway.io reserves the right to change any and all features of our Services at any time, without notice.

These Terms of Business hereunder are governed by the laws of Singapore, and all disputes arising from these terms shall fall within the exclusive jurisdiction of the Courts of Singapore.
